These Terms of Service (the “Terms”) apply when you visit www.tripleonedesigns.com.au, purchase from Triple One Designs Australia (“Triple One Designs”, “we”, “us” or “our”), upload artwork or otherwise use our website and services.
By accessing our website or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, please do not use the website or place an order.
1. About our store
Triple One Designs Australia creates and sells personalised apparel, gifts, custom printing and related products. Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products and services.

2. Eligibility and customer accounts
You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order. You agree that the information you provide at checkout is accurate, current and complete.
You are responsible for keeping your account and login details secure and for activity carried out through your account. Please notify us promptly if you believe your account has been accessed without permission.
3. Products, images and descriptions
We make reasonable efforts to present our products, colours, materials, sizing and designs accurately. However:
- Colours may appear differently between screens and the finished product.
- Placement and scale may vary slightly between garment styles and sizes.
- Product measurements may have normal manufacturing tolerances.
- Handmade and personalised items may have small natural variations.
- Packaging may change without affecting the product.
Please read the full product description, size guide and personalisation instructions before ordering. Nothing in this section limits your rights if a product is faulty, materially different from its description or otherwise fails to meet a consumer guarantee.
4. Personalised and custom-made products
Personalised and custom-made products are created using the details, wording, colours, sizes, photographs or artwork you submit. You are responsible for checking all names, dates, spelling, punctuation, garment selections and other instructions before placing your order or approving a proof.
We may make minor adjustments to the size, position or layout of artwork to achieve a suitable print result. If a requested design cannot be produced as submitted, we may contact you for clarification or an alternative file.
Personalised products supplied correctly are not eligible for change-of-mind returns or size exchanges. This does not exclude your rights if the product is faulty, damaged, significantly different from its description or not what you ordered.
5. Customer-supplied artwork, photographs and wording
When you upload or send us artwork, photographs, logos, names or other content, you confirm that:
- You own the content or have all permissions required for us to reproduce it.
- Your use of the content does not infringe another person’s copyright, trade mark, privacy, publicity or other rights.
- You have permission from identifiable people shown in photographs and, where a child is shown, permission from their parent or legal guardian.
- The content is not unlawful, threatening, hateful, defamatory, obscene or otherwise inappropriate.
You grant us a limited, non-exclusive licence to access, resize, crop, position, reproduce and print that content only as reasonably necessary to assess, produce and fulfil your order, provide customer support and comply with our legal obligations.
We may refuse or cancel a request if we reasonably believe the content is unlawful, infringes another person’s rights, is unsafe or is unsuitable for production. If we cancel before production for one of these reasons, we will refund any amount paid for the affected item, except for any separate work or service already completed with your prior agreement where permitted by law.
6. Artwork proofs and approvals
If you select or are offered a digital proof, production may be paused until you approve it. Please check every detail carefully. Your approval confirms that the layout, spelling, dates and other visible details are correct.
Colours displayed in a digital proof are indicative only because screens and printed materials reproduce colour differently. Minor positioning or scale adjustments may be required for different garment sizes.
Changes requested after approval or after production has begun may not be possible and may require additional payment if new materials or production are needed. We will tell you about any additional charge before proceeding.
7. Orders and acceptance
Submitting an order and receiving an automated confirmation does not prevent us from checking product availability, artwork suitability, pricing and order details. An order is accepted when payment is successfully processed and we begin fulfilling it.
We may contact you if information is missing or unclear. A delay in receiving your response may delay production and dispatch.
We may cancel or decline an order where:
- A product or required material is unavailable.
- A price, promotion or product detail contains a clear error.
- Payment cannot be authorised or the transaction appears fraudulent.
- Customer-supplied content does not meet the requirements in these Terms.
- We cannot safely or lawfully fulfil the request.
If we cancel an order, we will notify you and refund the affected amount, except for any separate work already completed with your prior agreement where permitted by law.
8. Prices, payment and promotions
Prices are displayed in Australian dollars unless stated otherwise. Applicable taxes, shipping charges and available discounts are shown at checkout.
Payment must be successfully authorised before an order enters production unless we have agreed to other payment terms in writing. You authorise us and our payment providers to process the amount shown at checkout.
Discount codes and promotions:
- Must be entered before checkout is completed.
- Cannot be exchanged for cash.
- Cannot be combined unless we expressly state otherwise.
- May be subject to dates, minimum spend, product or customer eligibility requirements.
- May be withdrawn or corrected where a genuine error has occurred, subject to applicable law.
9. Order changes and cancellations
Please contact us as soon as possible if you need to change or cancel an order. We will help where reasonably possible, but personalised production can begin quickly.
Once artwork preparation or production has begun, a change or cancellation may not be possible. If we agree to a change that requires additional materials, artwork or production, we will advise you of any additional charge before proceeding. Your rights under the Australian Consumer Law are not affected.
10. Production, shipping and delivery
Custom orders are generally prepared within 2–4 business days. Artwork proofs, customer changes, large orders, product availability and busy seasonal periods may require additional time.
Delivery estimates begin after dispatch and are not guaranteed arrival dates. Express Post speeds up delivery after dispatch but does not change production time. Tracking information is provided when available.
You are responsible for providing a complete and accurate delivery address. Contact us immediately if an address needs correction. Once dispatched, an address change or parcel redirection may not be possible.
If an order is returned because the address supplied was incomplete or incorrect, or because the parcel was not collected, we may require payment of reasonable additional postage before resending it. This does not apply where the delivery problem was caused by us or where the law requires otherwise.

11. Returns, refunds and consumer guarantees
Change-of-mind returns, exchanges and store credits are governed by our Refund Policy. Personalised and custom-made items supplied correctly are not eligible for change-of-mind returns or exchanges.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. If a product or service fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation or compensation depending on the circumstances and whether the failure is major or minor.
Nothing in these Terms excludes, restricts or modifies any consumer right or remedy that cannot lawfully be excluded, restricted or modified.
12. Gift cards and store credit
Gift cards and store credit may be used only in accordance with the conditions stated when issued and applicable law. They cannot be redeemed for cash except where required by law. You are responsible for keeping gift card codes secure.
13. Reviews and other submitted content
If you submit a review, testimonial, photograph, comment or other content for publication, you confirm it is accurate, lawful and based on your genuine experience.
You grant us a non-exclusive, royalty-free licence to display, reproduce and format that submitted content for our website and business marketing. We will not intentionally publish your private contact or payment information. You may contact us to request removal, although we may retain records where reasonably required by law or for dispute management.
We may moderate or remove content that is unlawful, misleading, abusive, discriminatory, irrelevant, contains private information or infringes another person’s rights. We will not suppress a genuine negative review merely because it is unfavourable.
14. Intellectual property
Unless otherwise stated, our website content—including our original designs, graphics, photographs, product descriptions, branding, layout and written material—is owned by or licensed to Triple One Designs Australia and is protected by applicable intellectual property laws.
You may view and use the website for personal shopping purposes. You must not copy, reproduce, sell, commercially exploit, distribute or create derivative works from our content without permission, except where permitted by law.
You retain ownership of original content you supply to us. The limited licence in section 5 allows us to use that content only for the stated purposes.
15. Acceptable use of the website
You must not use the website or services to:
- Break any applicable law or infringe another person’s rights.
- Transmit malware, harmful code or material intended to disrupt the website.
- Attempt to gain unauthorised access to accounts, systems or customer information.
- Use false information, engage in fraud or interfere with another customer’s order.
- Scrape, harvest or commercially exploit website content or customer data without permission.
- Place orders for resale where we have not agreed to wholesale or commercial terms.
We may restrict access or cancel affected transactions where reasonably necessary to protect customers, our business or the security of the website, subject to applicable law.
16. Third-party services and links
Our store may use or link to third-party services such as Shopify, payment providers, delivery providers, review platforms and social media services. Those providers may have their own terms and privacy practices.
We are not responsible for the content or availability of an unrelated third-party website. This does not limit any responsibility we have for the products or services we sell to you, or any liability that cannot be excluded by law.
17. Privacy
Our collection, use and disclosure of personal information is described in our Privacy Policy. When you upload artwork or photographs, please do not include unnecessary sensitive information.
18. Website availability and information
We aim to keep the website available and accurate, but maintenance, technical problems or events outside our reasonable control may occasionally interrupt access or cause delays. We may update website content, features and product availability from time to time.
To the extent permitted by law, we do not guarantee that the website will always be uninterrupted, error-free or free from harmful components. This does not affect any non-excludable statutory guarantee.
19. Liability
Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or remedies that cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when you placed your order, or for delay or loss caused solely by events outside our reasonable control. Any limitation in this section applies only to the extent it is fair and lawful in the circumstances.
20. Events outside reasonable control
Events such as carrier disruption, severe weather, natural disaster, fire, power or internet failure, government action, supplier interruption or widespread illness may delay performance. If this occurs, we will take reasonable steps to minimise the effect and communicate material delays. Your rights under applicable law remain unaffected.
21. Changes to these Terms
We may update these Terms to reflect changes to our products, services, website or legal obligations. The updated version will be published on this page with a revised “Last updated” date.
The Terms in effect when you place an order will generally apply to that order unless a change is required by law or you agree otherwise.
22. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down or removed only to the extent necessary. The remaining provisions will continue to apply.
23. Governing law
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws. Nothing in this section prevents a consumer from relying on rights or protections available under the law that applies to them.
